Can I receive SSD benefits if I have returned back to work?

What happens if a California resident was disabled for more than a year and applied for Social Security Disability benefits, but was able to return to work before their claim was adjudicated upon-can that person still receive disability benefits? The Social Security Administration may provide benefits for what is considers a closed period.

According to the SSA, a closed period of disability is the time between the beginning of a disability and the time when a person is able to become gainfully employed once again. Unlike other forms of disability, a closed period has a specific start date-the date one becomes unable to work-and a close date-the date one can return to work.

The criteria for being eligible to receive these benefits is specific-the disability must have persisted for at least 12 months and the application must have been filed within 14 months of the ending of the disability. If one can show they missed the deadline because of an impairment, the deadline could possibly be extended. Its also possible that someone who applied for ongoing benefits receives closed period SSD benefits-this is if the SSA determines that the person's condition has significantly improved since they filed the application and even though it can end up denying ongoing benefits, it awards closed period ones.

The process may be confusing to some, as may be the terminology. It often helps if there is someone knowledgeable about the process by one's side, advocating for them. An experienced attorney may be able to provide that guidance and ensure individuals get the benefits they deserve, based on their individual situations.
